This document is an electronic record in terms of the amended Information Technology Act, 2000 and rules and regulation made thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the Terms for access or usage of Xcredo service via Xcredo Portal. This document meets the stipulations and conditions mentioned in Section 65B (2) of the Indian Evidence Act, 1872.

ACCEPTANCE OF TERMS :

This is an agreement between you ("you" or "your") and Xcredo pvt. Ltd, a company incorporated under the Companies Act 1956 with its registered office at Building 7, second floor , shree classic empire, Mahesana, Gujrat-384002 ("Xcredo" "we," or "our") It governs your use of the search services provided by Xcredo through its website www.Xcredo.com ("Website"), as well as via telephone search, SMS, WAP or any other medium using which Xcredo offers such services (collectively referred to as the "Platforms" ). By accessing or using of the any Platforms you agree to be bound by these Terms and Conditions ("Terms"). These Terms and Conditions (“Terms”) govern the services, access to, and use of the Xcredo Business platform by Sellers for the purpose of offering their products and services to end customers of Xcredo (“Customers”).

Rights of USE :

We use various types of content—text, images, graphics, videos, audio, designs, and advertisements (together called “Materials”)—on our Platforms. These are provided only for your personal and non-commercial use.

  • While we try to ensure the accuracy of the content, Xcredo is not responsible for any loss, damage, or issues that may arise from using or relying on the Platforms, including loss of data, revenue, or exposure to viruses.
  • You may view, copy, or share the Materials only for internal, non-commercial purposes. Activities like data mining, scraping, automated queries, or creating competing listings/services are not allowed. You also cannot use the Platforms for unsolicited marketing.
  • All copyrights, trademarks, and other intellectual property rights in the Materials remain with Xcredo, its affiliates, or the respective owners.

Use of Xcredo Brand Assets :

Xcredo name, logo, product and service names, designs, and slogans are owned by Xcredo or its group companies. Other brand names belong to their respective owners. If you copy or use any Xcredo materials, the original copyright or trademark notice must be kept. You are not allowed to use Xcredo name or logo for advertising, promotion, or any commercial purpose without prior written approval from Xcredo. For permission, please contact intproperty@xcredo.com

How we use your info :

Please don’t send us confidential or proprietary information. Unless it’s personal information covered under our Privacy Policy, anything you share with us (such as feedback, ideas, suggestions, questions, or comments) will be treated as non-confidential. We are not obligated to protect or keep such information private. We may freely use, share, reproduce, or distribute it, and we can also apply any ideas or concepts you provide for purposes like developing, improving, or marketing our products and services.

PRIVACY NOTICE :

We value your trust and take the privacy of your information seriously. This Privacy Notice explains how Xcredo Pvt. Ltd. and its affiliates (“Xcredo”) collect, use, and protect your personal information across our websites, services, devices, products, and applications (“Xcredo Services”). By using Xcredo Services, you consent to our collection, storage, processing, transfer, and sharing of your personal information (including sensitive information) as described in this Privacy Notice, which may be updated from time to time. Your personal information will be collected and maintained by Xcredo at its registered office: Building 7, Second Floor, Shree Classic Empire, Mahesana, Gujarat – 384002.

The security of your Personal Information is important to us. You are responsible for keeping your device and your account safe and secure, and you must notify us promptly of any unauthorized use or security breach of your account or our Services. Your account information is protected by the password you use to access your online account. Please keep this password confidential. Xcredo uses commercially reasonable physical, managerial, and technical, electronic and procedural safeguards to preserve the integrity and security of your personal information. Xcredo shall adopt reasonable security practices and procedures as mandated under applicable laws for the protection of your Information. For this purpose, Xcredo adopts internal reviews of the data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where Xcredo stores your Personal Information. We cannot, however, ensure or warrant the security of any information you transmit to Xcredo and you do so at your own risk and you hereby waive and release Xcredo from any claim of damages under contract.

If any shop owner or service provides incorrect, misleading, or fraudulent documents, XCredo shall not be held liable or responsible for any financial or legal actions arising from such documents. All verification and legal compliance remain the sole responsibility of the shop owner/caretaker.
What Xcredo do :

XCredo Pvt. Ltd. operates as an online service aggregation and discovery platform that connects customers with independent local vendors, service center and Professional & Institutional, medical service and legal Services provider.

  • We allow vendors (such as grocery stores, salons, restaurants, medical shops, garages, gyms, hotels, etc.) to register and list their business details on the XCredo platform, including business name, address, contact information, category, operating hours, and services offered.
  • The platform enables customers to search, discover, and connect with vendors based on location, category, and service requirements, either instantly or through scheduled requests.
  • The XCredo platform facilitates the exchange of contact details and service enquiries. Vendors may contact customers, and customers may contact vendors, directly through phone calls, messages, or other communication modes available on the platform, for the purpose of product or service or institutional or legal service or medical service-related discussions but XCredo shall not be responsible for the content or outcome of such communications.
  • We provide vendors with basic digital visibility, including profile display and promotional features as may be offered from time to time.
  • XCredo provides customers with the option to either directly contact vendors for purchases or service enquiries, or to place orders and service requests through the XCredo app or website, as may be available from time to time.
  • If customer order anything (product and service if available) payment service provide through Xcredo app via COD, credit card, debit card or upi.
  • We may send service-related notifications, alerts, reminders, or updates to users through SMS, WhatsApp, in-app notifications, email, or other electronic means
  • XCredo provides technical support related to platform usage, account management, and issue resolution, subject to availability and business policies.
  • Xcredo may suspend or terminate vendor access for - Misconduct, fraud, or unethical behavior, Data misuse or complaint escalation, Breach of these Terms & Conditions, Legal or safety violations, Use the App for illegal or unauthorized activities.
  • Information collected automatically when you use Xcredo, such as:
    • Your device and browser details (mobile, desktop, app version).
    • Your location when using location-based services.
    • Search history and pages visited (e.g., services you browse or vendors you view).
    • Cookies and identifiers that help us remember your preferences.
Xcredo doesn’t collect information :

Xcredo does not collect emails, bank related details, addresses or other contact information from your mobile address book or contact lists other than name and mobile phone numbers. Xcredo does not store historical location information in any form or manner at its end, except for last known location from which Xcredo software was accessed in case of non-availability of current location data. Xcredo App integrates with face-book SDK and may send aggregate usage statistics to face-book from time to time. Usage of information sent to face-book is governed by Facebook's data usage policies which can be found at www.facebook.com/about/privacy.

All user (vendor/service provider/professional service provider/legal service provider/institutional) responsibility :
  • To use XCredo, users must create an account, either as a customer (“Customer Account”) or as a vendor/business (“Business Account”), as applicable, and provide the required and accurate registration information (already mention in data provide section).
  • All user shall provide true, accurate, complete, and up-to-date business information, including -mobile number, email ID, proprietor/owner name, business name, business category/type, address, contact details, licenses, registrations, payment related information and any other information submitted during the registration process.
  • During product listing -You shall provide correct images and description of the product and monitor whether the same is being reflected correctly on the Xcredo website from time to time.
  • All user (Vendors and customers) shall use the platform only for product purchase/sell and service provide/need purposes and shall not misuse and not sell any contact details, services, or information obtained through the platform.
  • Unauthorized upselling, hidden charges, or misleading communication is prohibited.
  • Not harass, threaten, or discriminate against customers or vendor.
  • Not share customer/vendor personal data with any third party.
  • Prices must be clearly communicated to the customer before service/delivery product.
  • Vendors agree to follow Xcredo data protection and privacy rules.
  • Vendor must respond promptly to bookings, communications, and customer queries.
  • Update business details, availability, pricing, inventory and address if you change.
  • As XCredo platform facilitates- Vendors may contact customers, and customers may contact vendors, directly through phone calls, messages, or other communication modes available on the platform, for only purpose of product or service or institutional or legal service or medical service other service your needed available in platform-related discussions but XCredo shall not be responsible for the content or outcome of such communications.
  • You must ensure that all items/service are listed in the appropriate category on Xcredo platform.
  • You must at all times ensure that all listed items are kept in stock for successful fulfilment of sales.
  • Customer must ensure accessibility of the service location at the scheduled time.
  • During service booking, the customer/service provider/service man has the option to :
    • Select required spare parts, kits, or materials directly from the XCredo App, OR
    • Provide their own spare parts or kits to the service provider.
    • If the user selects parts through the XCredo App, pricing will be display before confirmation.
    • If the user provides their own parts the service provider/Xcredo are not responsible for the quality, compatibility, or performance of those parts.
    • Customer must be ensuring service quality before leaving service provider.
  • Vendors must comply with all applicable laws: labour laws, GST & tax regulations, safety rules during product buy/service provide.
  • XCredo shall not be responsible or liable for any payment disputes, delays, failures, refunds, or claims arising from any direct purchase or transaction between customers and vendors conducted after communication or outside the XCredo platform.
How we use your information :

We use your personal information to:

  • Provide Services – to process your bookings and payments, and to share updates or promotional offers.
  • Improve Xcredo – by fixing issues, analyzing performance, and making our services more user-friendly.
  • Personalize Your Experience – recommending vendors, products, or services that match your interests.
  • Communicate with You – through email, phone, or chat about your account, services, or support needs.
  • Ensure Safety & Security – to detect and prevent fraud, protect accounts, and manage credit risks.
Reviews, ratings & comments by all user :

By using Xcredo platforms (SMS, WAP, Email, Website, App, Voice/Phone), you agree to the following:

  • You are solely responsible for any content you post (Reviews, Ratings, Comments – “Communications”). Xcredo does not endorse or guarantee your content.
  • You confirm you own or control all rights to your content and it does not violate laws or harm any person/entity.
  • Xcredo may monitor, edit, or remove content at its discretion, especially if it is: - Obscene, abusive, defamatory, false, misleading, or offensive, Violating intellectual property, laws, or third-party right,
  • Breaching site security or collecting user data without consent is strictly prohibited.

Disclaimer on Advertisers & Services

  • The XCredo platform, including its website, mobile application, and all related services, features, content, and materials (collectively, the “Platform”), is provided on an “as is” and “as available” basis, without any representations or warranties of any kind, whether express, implied, statutory, or otherwise.
  • Any goods or service provider may register on Xcredo. We do not check or guarantee their quality, reputation, or reliability. Users must verify all details and terms on their own before dealing with any provider. Any purchase or service taken is at your own risk.
  • All use of the Platform and its materials is at your own risk. Xcredo does not guarantee that the content or links available on the Platform are accurate, complete, or always available.
  • XCredo is a technology-based intermediary and facilitation platform and does not provide medical, healthcare, educational, legal, financial, property, real-estate, or other professional services, nor does it provide professional advice of any kind.
  • XCredo does not verify medical credentials, treatments, diagnoses, prescriptions, or outcomes, and makes no warranties regarding the suitability, safety, or effectiveness of such services.
  • XCredo does not guarantee course content, faculty quality, admissions, certifications, placements, results, or outcomes.
  • XCredo does not provide legal advice, does not draft, validate, or authenticate legal documents, and does not guarantee their accuracy, legality, enforceability, or suitability.
  • XCredo does not verify ownership, title, approvals, pricing, encumbrances, legality, or property condition. Users are solely responsible for conducting due diligence before entering into any property-related transaction.
  • XCredo does not warrant that the Platform will be uninterrupted, secure, timely, or error-free, nor that any information, listings, communications, or content provided by vendors or users will be accurate or complete.
Payments, commission, Refunds & Settlements :

XCredo provides customers with multiple payment options, subject to availability :

  • Direct Payment to Vendor:
    Customers may choose to pay vendors directly using cash, UPI, bank transfer, or any other mode agreed between the customer and the vendor. In such cases: XCredo is not involved in the payment transaction, XCredo does not collect, process, hold, or settle such payments, All payment-related responsibilities rest solely with the customer and the vendor.
  • Payment Through XCredo Platform:
    Customers may place orders or service requests through the XCredo app or website and make payments using supported electronic payment methods, including credit cards, debit cards, UPI, wallets, or other digital modes as enabled from time to time.
  • Payment processing & third-party gateway:
    Payments made through the XCredo platform are processed via authorized third-party payment gateways and banking partners. XCredo does not store customers’ card details, CVV, PINs, or other sensitive financial information. XCredo shall not be responsible for payment failures, delays, reversals, or errors caused by banks, payment gateways, network issues, or third-party service providers.
  • Vendor payouts & settlements:
    Amounts collected through the XCredo platform may be settled to vendors after deduction of applicable commissions, service fees, taxes, or other charges, as per the agreed commercial terms. Settlement timelines are subject to: successful completion of the order/service, refund or cancellation status, and payment gateway settlement cycles. Please Note: - XCredo reserves the right to withhold or adjust settlements in case of suspected fraud, excessive cancellations, customer complaints, or regulatory requirements.
  • Commissions, Platform Fees & Taxes:XCredo may charge vendors a commission, service fee, or other platform charges, delivery charge as communicated separately or displayed on the platform. All fees are exclusive of applicable taxes unless expressly stated otherwise. All user (vendor/customer) are solely responsible for: compliance with GST and other applicable tax laws, issuing tax invoices to customers where required.
  • Refunds, Cancellations & Chargebacks:
    For orders placed and paid for through the XCredo platform: a) Refunds, if applicable, shall be governed by the relevant refund and cancellation policy displayed on the platform, b) Refunds will be processed through the original payment method, subject to vendor approval and payment gateway timelines, c) Convenience fees, gateway charges, or platform fees may be non-refundable, unless required by law. Direct Vendor Payments: For transactions where customers pay vendors directly: a) XCredo shall not process or facilitate refunds, b) Any refund, cancellation, or dispute must be resolved directly between the customer and the vendor, c) XCredo bears no responsibility or liability in such cases.
  • No guarantee of payment completion
    XCredo does not guarantee that any transaction will be successfully completed and shall not be liable for losses arising from: declined or failed payments, incorrect payment details, user error, technical or network issues.
Information uses :

The data/information collected shall be used for the purpose for which it has been collected. In addition, the Xcredo uses the data for the following purposes: 1) To provide services, 2) To fulfill your requests for products and services and communicate with you about those requests. If you search the products or service from our platform without logged in or sought the information by calling our hotline, we collect mobile number and generate lead with our vendors/service providers, as per your choice/request. If you search the products or service from our platform with logged in, we share your information (i.e., name, mobile, email etc.,) as available with us with our vendors/service providers to fulfil your choice/request, 3) To administer contests, sweepstakes, promotions, and surveys, 4) To respond to reviews, comments, or other feedback you provide us, 5) To help us personalize our service offerings, websites, mobile services, and advertising, 6) To provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Services, 7) To recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with Xcredo Services, 8) To operate, provide, develop, and improve the products and services that we offer our customers, 9) To provide our services and to support our core business functions. These include order or service fulfilment, internal business processes, marketing, authentication, loss and fraud prevention, public safety and legal functions, 10) To display interest-based ads for features, products, and services that might be of interest to you, 11) To prevent and detect fraud and abuse in order to protect the security of our customers, Xcredo, and others, 12) Contacting with you for promoting services, 13) The User's Personal Data may be used for legal purposes by Xcredo in legal proceeding at the stages leading to possible legal action arising from improper use of Xcredo services, 14) We use your voice input, images, videos, and other personal information to respond to your requests, provide the requested service to you, and improve our services, 15) For operation and maintenance purposes, 16) It helps us in operating, providing, improving, understanding, customizing, supporting, and marketing our Services, 17) Comply with legal obligations. In certain cases, we collect and use your personal information to comply with laws. For instance, we collect from seller’s information regarding place of establishment and bank account information for identity verification and other purposes.

Personal Information will be kept confidential and will be used for our research, marketing, and strategic client analysis objectives and other internal business purposes only. We do not sell Personal Information. If you are a customer of our services, your Information shall be shared with our subscribers/advertisers and you shall be given consent to the same. Further, the subscribers / advertisers who are listed with us, may call you, based on the query or enquiry that you make with us, enquiring about any Product / Service or Product / Service of any subscriber / advertiser. If you are a vendor/seller/business entity availing our services, your information shall be shared with our users, customers, callers, subscribers/advertisers who are seeking our services. You are hereby giving us the consent to share the details.

We use your personal information to assist vendors, service providers, and business partners in handling and fulfilling orders; enhancing customer experience; resolve disputes; troubleshoot problems; help promote a safe service; collect money; measure consumer interest in our products/services; inform you about offers, products, services, and updates; customize and enhance your experience; detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection of information.

With your consent, we will have access to your SMS, contacts in your directory, location and device information. We may also request you to provide your details as mention above to: (i) check your eligibility for certain products and services including but not limited to credit and payment products; (ii) issue GST invoice for the products and services purchased for your business requirements; (iii) enhance your experience on the Platform and provide you access to the products and services being offered by us, vendors, sellers, service providers, affiliates or lending partners. You understand that your access to these products/services may be affected in the event consent is not provided to us.

In our efforts to continually improve our product and service offerings, we and our affiliates collect and analyses demographic and profile data about our users' activity on our Platform. We identify and use your IP address to help diagnose problems with our server, and to administer our Platform. Your IP address is also used to help identify you and to gather broad demographic information.

We will occasionally ask you to participate in optional surveys conducted either by us or through a third-party market research agency. These surveys may ask you for your interests, household or lifestyle information, your purchasing behavior or history, preferences, and other such information that you may choose to provide. The surveys may involve collection of voice data or video recordings, the participation of which would purely be voluntary in nature. We use this data to tailor your experience at our Platform, providing you with content that we think you might be interested in and to display content according to your preferences.

Transfer of information :

Xcredo shall not transfer sensitive personal data or information including any information, to third parties in India, or outside India, except under the following circumstances:

  • To fulfill your requests for products and services
  • To fix errors, and improve the usability and effectiveness of the Services
  • To fraud prevention, public safety and legal functions
  • To prevent and detect fraud and abuse in order to protect the security of our customers, Xcredo, and others
  • It is necessary for the performance of the lawful contract between Xcredo and data principal; or
  • where data principal has consented to data transfer;

However Xcredo ensures the same level of data protection that is adhered to by them as that of Xcredo as provided for.

When using vendors to collect personal information on the behalf of Xcredo, it shall ensure that the vendors comply with the data protection requirements of Xcredo as defined in this Policy.

Retention of your information :

The Personal information may only be used for the purposes identified in the TOS and only if you have given consent. Personal information shall be retained for as long as necessary for business purposes identified in the TOS at the time of collection or subsequently authorized by you. We retain your personal information in accordance with applicable laws, for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse or if required by law or for other legitimate purposes. We may continue to retain your data in anonymized form for analytical and research purposes.

When the use of personal information is no longer necessary for business purposes, a method shall be in place to ensure that the information is destroyed in a manner sufficient to prevent unauthorized access to that information or is de-identified in a manner sufficient to make the data non-personally identifiable. Xcredo shall have a documented process to communicate changes in retention periods of personal information required by the business to you who are authorized to request those changes.

Xcredo holding sensitive personal data or information shall not retain that information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. Xcredo has framed the data retention policy and it retains all sorts of data/information including sensitive personal data or information in accordance with data retention policy. The data/information shall be de-identified/destroyed, when the purposes of data collection can be achieved, in accordance with our data retention policy.

Personal information shall be erased if their storage violates any of the data protection law or if knowledge of the data is no longer required by Xcredo or for the benefit of the data providers. Additionally, Xcredo has the right to retain the personnel information for legal and regulatory purpose as per applicable laws. Xcredo shall perform an internal audit on an annual basis to ensure that personal information collected is used, retained and disposed-off in compliance with the applicable law.

Your constant :

By visiting our Platform providing your information, you consent to the collection, use, storage, disclosure and otherwise processing of your information (including sensitive personal information) on our Platform in accordance with this Privacy Policy. If you disclose to us any personal information relating to other people, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy. You, while providing your personal information over our Platform or any of our partner Platform or establishments, consent to us (including our affiliates, lending partners, technology partners, marketing channels, business partners, vendors, service providers and other third parties) to contact you through SMS, instant messaging apps, call and/or e-mail for the purposes specified in this Privacy Policy.

If you want to manage, change, or edit your information, we allow you to do so through the Settings tools: You can change your settings to manage certain information available to other users. You can manage your contacts, groups, and broadcast lists, or use our block feature to manage the users with whom you communicate.

If you are vendors, you can add or update certain information in vendor’s module, update your account information by accessing your vendors Account Information, and adjust your e-mail or other communications you receive from us by updating your Notification Preferences.

You can add or update your Personal Information on regular basis. Xcredo would retain your previous Personal Information in its records. If you wish to delete your personal data from our

Platform, you can follow the steps outlined below:

  • Navigate to the Settings option from the side menu and select Support.
  • Choose the Profile Deactivation option.
  • To fraud prevention, public safety and legal functions

Once deleted, your personal information will no longer be accessible on our Platform. However, certain data may be retained for legal, compliance, or operational reasons as required by applicable regulations. If you require further assistance regarding data deletion, you may contact our support team via email at privacy@Xcredo.com

You may, of course, decline to submit Personally Identifiable Information through the Xcredo Service, in which case Xcredo may not be able to provide certain services to you. If you do not agree with our Privacy Policy or Terms of Service, please delete your account and uninstall the Xcredo mobile application; your continued usage of the Xcredo Service will signify your assent to and acceptance of our Privacy Policy and Terms of Service. To protect your privacy and security, we take reasonable steps (such as SMS authentication in certain cases) to verify your identity before registering your mobile phone number and granting you access to the Xcredo Service. Please contact Xcredo via email to privacy@Xcredo.com or available web forms with any questions or comments about this Privacy Policy, your personal information, your consent, or your opt-in or opt-out choices.

Xcredo shall, prior to the collection of information including sensitive personal data or information, provide an option to you to not to provide the data or information sought to be collected. Xcredo shall establish systems for the collection and documentation of Your consent to the collection, processing, and/or transfer of personal data. You shall be informed about the choices available to them with respect to the collection, use, and disclosure of personal information.

Further, Xcredo shall establish & facilitates a mechanism to enable You to, at any time while availing the services or otherwise, to withdraw its consent given earlier to Xcredo. If You not providing the consent or later on withdrawing your consent, Xcredo reserves its right not to provide goods/services for which the said information was sought. Consent shall be obtained (in writing/electronically) from You before or at the time of collecting personal information or as soon as practical thereafter.

The changes to your preferences shall be managed and documented. Consent or withdrawal of consent shall be documented appropriately. The choices shall be implemented in a timely fashion and respected. If personal information is to be used for purposes not identified in the at the time of collection, the new purpose shall be documented, you shall be notified, and consent shall be obtained prior to such new use or purpose. You shall be notified if the data collected is used for marketing purposes, advertisements, etc. Xcredo shall review the policies of the Third Parties and types of consent of Third Parties before accepting personal information from Third-Party data sources.

Dispute resolution & governing law of India :

Any dispute, controversy, or claim arising out of or relating to these Terms, the XCredo platform, or the use of services, including any question regarding its existence, validity, interpretation, performance, breach, or termination (“Dispute”), shall be resolved in accordance with the provisions set out below.

In the event a dispute arises between you and Xcredo as per these Terms, the parties shall attempt to amicably resolve the dispute through mutual discussions. Where the dispute is not resolved for a period of 90 days from the date of the dispute, either party can, upon giving a written notice to the other party, declare its intention to initiate arbitration proceedings. The arbitration will be conducted in English in accordance with the rules prescribed under the Arbitration and Conciliation Act, 1996. The venue for the arbitration shall be Gujarat. The arbitration shall be conducted by a sole arbitrator appointed by Xcredo. The award of the arbitrator shall be final and binding on the parties. Each party shall bear its own cost of arbitration.

These Terms shall be governed by and construed in accordance with the laws of India.

Limitation of liability :

To the fullest extent permitted by applicable law, in no event shall XCredo Pvt. Ltd., or any of its directors, officers, employees, agents, affiliates, or service providers (collectively, the “XCredo Representatives”) be liable to you for any direct, indirect, incidental, consequential, exemplary, special, remote, or punitive damages, including but not limited to damages for loss of profits, revenue, goodwill, business opportunities, use, data, or other intangible losses, arising

out of or directly or indirectly related to:

  • the use of, or inability to use, the XCredo platform (app or website);
  • any listings, content, materials, features, or functionalities available on the platform;
  • any communication, interaction, or transaction between customers and vendors
  • any products or services ordered, availed, or not availed through or outside the platform;
  • any information provided by vendors or users on the platform;

even if XCredo or any XCredo Representatives have been advised of the possibility of such damages.

Without limiting the generality of the foregoing, in no event shall XCredo or XCredo Representatives be liable for:

  • the use of or inability to use the XCredo platform or any of its features or services;
  • non-performance, delay, cancellation, deficiency, or failure of any product or service provided by vendors;
  • any loss, damage, injury, or harm arising from services including but not limited to medical, healthcare, educational, legal, institutional, or property-related services;
  • any payment-related disputes, delays, failures, refunds, chargebacks, or claims arising from transactions between customers and vendors, whether conducted directly or through third-party payment gateways;
  • any other matter relating to vendor conduct, listings, pricing, availability, or service quality.

By using the XCredo platform, you expressly acknowledge and agree that XCredo acts solely as an intermediary and facilitation platform and is neither responsible nor liable for any act, omission, representation, warranty, breach, or misconduct of vendors, customers, or other third parties.

XCredo is not obligated to mediate, monitor, or resolve disputes between customers and vendors or between users of the platform.

None of the directors, officers, employees, or representatives of XCredo shall be personally liable for any claims, actions, losses, or damages arising out of or in connection with the use of the XCredo platform or services.

Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is not permitted under applicable Indian law.

XCredo reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective once posted in the App.
